Throughout the Privacy Policy, the terms “we,” “us,” and “our” refer to Vigit and the terms “you” and “your” refer to any visitor to or user of the Website or the App. 

This Privacy Policy is intended to help you understand the types of information we may collect from you or that you may provide when you visit the Website or download, install, register with, access, or use the App, and describes our practices for collecting, using, maintaining, protecting and disclosing such information. 

This Privacy Policy only applies to information that we collect, or store or that you provide to us through the Website or the App or when you communicate with Vigit via email, and does not govern information collected from you in any other manner. We make no representations or warranties regarding: (i) the websites, apps, or policies of any third-party (including any third-party website or app that the Website or App may link to or the policies of such third-party websites or apps) or (ii) how any third-party will handle your Personally Identifiable Information. We encourage you to review the privacy policy of any third-party website or app before accessing such website or app. 

In viewing and using the Website and/or the App, you understand that Vigit may use certain information, including your Personally Identifiable Information (as defined below) subject to the terms of this Privacy Policy, and you consent to (i) the terms of this Privacy Policy; (ii) to the collection, use, and sharing of your Personally Identifiable Information and other information by Vigit pursuant to the terms of this Privacy Policy; and (iii) to the terms and conditions of the Terms of Use located at (the “Terms of Use”). 

You may only access and use the Website and/or the App if you are located within the United States, so only those laws applicable throughout the United States are implicated herein. The Website and/or the App are only intended for use by persons in the United States. 

Changes to the Privacy Policy 

We encourage you to review our Privacy Policy not just the first time you visit the Website or the App but periodically afterwards since we may modify our Privacy Policy from time to time. The date of the last update of the Privacy Policy will always be posted below:

If we make material changes to how we treat our users’ Personally Identifiable Information, we will notify you by email to the email address specified in your Vigit Account and/or through a notice on the Website home page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this Privacy Policy to check for any changes. By providing us with your email address, you consent to us sending you notice via email of our Privacy Policy changes. 

Your continued use of the Website or the App after the changes are posted or after we notify you via email constitutes your agreement to the changes, both with regard to information we have previously collected from you and with regard to information we collect from you in the future. If you do not agree to the changes, please discontinue use of the Website and the App. Lastly, if Vigit is sold or merged with another company, your Personally Identifiable Information will be included as part of the sale, but unless you’re notified that the Privacy Policy is changed, your Personally Identifiable Information will be maintained in the same manner as described in the Privacy Policy. 

The Website and the App Are Not Intended For Use By Individuals Under 18 Years of Age 

Our Website and our App are not intended for anyone under eighteen (18) years of age. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not: (i) use or provide any information on the Website or the App or, on or through any of the features available on the Website or the App or (ii) provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you seek to or may use. If we learn we have collected or received personal information from an individual under 18, we will delete that information. Collection of Information 

When you access or use the Website, and/or download, register with or use the App, we may collect information from you subject to the terms of this Privacy Policy, including information by which you may be personally identified (“Personally Identifiable Information”) as well as information that is about you, but that does not identify you individually. The information we may collect and maintain about you includes but is not limited to your: 

  • Contact information, such as name, email address, zip code, and telephone numbers, including mobile telephone numbers; 
  • User name; 
  • Age and date of birth; 
  • Gender; 
  • Location coordinates (longitude, latitude, and radius) if you use your mobile phone or a GPS- equipped device to access the Website and/or the App; and 
  • Unique identifiers, such as an Internet Protocol address, a processor or device serial number or other unique device identifiers, that are combined with Personally Identifiable Information. 

We may collect Personally Identifiable Information from you so that we can: 

  • Provide you with access to specialized portions of the Website and the App (your “Vigit Account”); 
  • Verify your identity and age; 
  • Suggest “friends” for you to connect with on the App and/or Website; 
  • Allow you to invite your mobile phone contacts to participate in the App or the Website; 
  • Store information about your preferences, allowing us to customize your Vigit Account according to your individual interests; 

  • Contact you to respond to inquiries related to the Website or the App; 
  • Notify you when App updates are available; 
  • Send you any prizes that you have won; 
  • Communicate with you to provide you with relevant information about Vigit, including special promotions, discounts and newsletters; 
  • Process orders and collect payments; 
  • Enforce or apply our Terms of Use and other agreements; 
  • Comply with licensing and regulatory requirements; 
  • Combat against security risks and fraudulent activity; 
  • Perform research and development, market research, customer surveys and customer profiling; and 
  • Confirm your geographic location. 

We collect Personally Identifiable Information for the purposes of providing these services, but may collect non-personal information in order to operate, maintain, and improve the Website, the App, and our services. 

We will collect Personally Identifiable Information from you if you voluntarily submit such information to us through the Website and/or the App or if such information is transmitted to us when you access the Website or the App, when you contact us or during our communication with you based on the information you’ve submitted to us. 

Vigit allows users to send messages to individuals stored in their mobile phone contacts in order to invite such individuals to participate in social gaming via the App or the Website. To invite your contacts to participate in the App or the Website, you must opt-in to allow Vigit to access your mobile phone contacts. By opting-in you authorize Vigit to access and use the names and phone numbers of the individuals stored in your mobile phone contacts so that you may use this feature. 

In the course of a free-to-play game, we may award a prize or prizes, such as a cash prize. We will collect your mailing address from you to send the winner or winners such prizes. In certain cases of prizes worth $600 or more, we may collect your social security or taxpayer identification number and address so that we can provide you with relevant tax forms. Any taxes due are your responsibility. 

You have a choice as to whether to provide us with Personally Identifiable Information. By submitting Personally Identifiable Information through the Website or the App, you agree to the terms of this Privacy Policy, you expressly consent to the use, processing, and sharing of your Personally Identifiable Information according to this Privacy Policy and you agree to the Terms of Use located at (the “Terms of Use”). You may choose not to provide certain information to us, but if so, you may not be able to participate in certain activities and transactions available at or through the Website or App. 

Security of Information 

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of Personally Identifiable Information, we have put in place reasonable physical, electronic, and managerial procedures to safeguard and secure the Personally Identifiable Information we collect online, and we make good faith efforts to store your Personally Identifiable Information in a secure operating environment. 

You must also seek to protect against unauthorized access to any information that you use in connection with the Website or the App, and you should remember to close the browser once you have completed your activities on the Website or the App or if you have decided to step away from your computer or mobile device. In the event that we determine that there has been a security breach resulting in the unauthorized disclosure of Personally Identifiable Information to a third party, we will notify individuals whose Personally Identifiable Information has been so disclosed as required by law. 

Unfortunately, no data transmission over the internet or through mobile platforms can be guaranteed to be absolutely secure. As a result, while we strive to protect your Personally Identifiable Information, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. 

Sharing of Information 

We may employ other companies and individuals to perform functions on our behalf. Examples include postal mail and email communications, payment processing, customer lists management, data analysis, marketing services and assistance (including providing marketing services presented on other websites or mobile applications), credit card processing, and customer relationship management. These companies and individuals have access to Personally Identifiable Information and other information needed to perform their functions, but they are not permitted to use such information for other purposes without our permission. 

We also reserve the right to use your personal information for any other purposes that are reasonably ancillary to the business of providing you with services related to the Website or App. 

Except as provided in this Privacy Policy, or as otherwise permitted or required under law, we reasonably attempt to ensure that we do not intentionally disclose any Personally Identifiable Information about you as an individual user to any third party without having first received your permission (through your opting in or otherwise agreeing to the disclosure of such information). 

We will release information, which may include Personally Identifiable Information, as required by law to comply with any valid legal inquiry or process such as a search warrant, subpoena, statute or court order. We will also release specific information, which may include Personally Identifiable Information, in special cases, such as if there is an attempted breach of the security of the Website or the App or if there is a physical or property threat to you or others. We may also transfer user information, including Personally Identifiable Information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division or other fundamental corporate change, or a financing or similar transaction, including as part of the diligence process for these transactions. Additionally, we may share your Personally Identifiable Information in connection with enforcing or applying our Terms of Use and other agreements or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Vigit, our customers or others. 

Consent to Communications 

When you use the Website or the App, we collect your Personally Identifiable Information (such as your name) and your mobile phone number to allow Vigit or a third party acting on Vigit’s behalf to contact you for customer service purposes and also to inform you of or follow-up with you about special 

promotions, optional contests, and special offers. We will share such information with necessary third parties for the purpose of carrying out the customer service, contest, special offer or promotion. You hereby expressly agree that Vigit or a third party acting on behalf of Vigit may contact you using the contact information you have provided to us or that have collected (including any phone numbers) concerning your Vigit Account or in connection with carrying out customer service, promotional offers and contests.

Electronic Communications and Opting in and Opting Out 

When you communicate with us electronically, via e-mail or otherwise, you consent to our use of the information you have provided, and you further consent to receive electronic communications from us. If you would prefer not to receive such communications, you can opt out of/unsubscribe to, our e-mail lists by clicking on the “opt out”/“unsubscribe” line at the bottom of the e-mail you receive from us. You should be aware, however, that (i) it is not always possible to completely remove or modify information in our databases and servers, although we will always make reasonable efforts to do so upon your request, (ii) we are unable to have your information removed from the records of any third party who has been provided with your information in accordance with this Privacy Policy; and (iii) we may still contact you concerning matters about your account. 

User Contributions 

If you provide information to be published or displayed (“Posted”) on public areas that may be available on the Website or App, such as Personally Identifiable Information or other information (collectively, “User Contributions”), that information is transmitted to others at your own risk, and can be collected and used by third-parties and by us without limitation. Although you may set certain privacy settings for such information, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. We recommend that you not submit Personally Identifiable Information in any public or semi-public forums, such as message boards or chat rooms. 

Cookies and Other Technologies 

The Website and/or App may use “cookies” and/or other technologies or files (collectively, “cookies”) to identify how visitors make use of the Website and/or App. This aggregate tracking information may be used to help us improve and enhance the website and mobile application experience for all of our visitors. If you would prefer not to have such cookies stored on your computer or mobile device, you may modify your browser settings to reject most cookies, or manually remove cookies that have been placed on your computer or mobile device. However, by so rejecting the cookies, you may be unable to fully access the offerings on the Website or App. Additionally, we may use IP address information to count and track aggregate visits to the Website and/or App, to help diagnose problems with our server, and to administer the Website and/or App. We do not link IP addresses to anything personally identifiable, so while a particular user’s session can be tracked, the user remains completely anonymous. 

We may also collect information through the use of clear gifs (also called Web Beacons and Web Bugs) in selected e-mail messages we send to you. These are tiny graphic files, not visible to the human eye, that are included in HTML-based e-mails and used to let us know which e-mails we send are opened. Clear gifs may also see or read cookies on your computer. When authorized by us, third parties specializing in monitoring aggregate statistical use of the Website or the App with whom we contract, may use cookies, our web log files, web beacons, and other monitoring technologies to compile anonymous aggregate data. 

Additional Automatic Information Collection Through The App 

When you download, access, and use the App, it may use technology to automatically collect: 

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App. 
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number. 
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information. 
  • Location Information. This App may collect real-time information about the location of your device in order to confirm your location and for statistical and operational purposes. You can choose whether or not to allow the App to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly. 

If you do not want us to collect Usage Details, Device Information, or Stored Information and Files, do not download the App or delete it from your device. 

Do Not Track Disclosures 

Some web browsers may give you the ability to enable a “do not track” setting that is an HTTP header field indicating your preferences regarding user tracking or cross-site tracking. This is different from disabling certain forms of tracking by declining cookies in your browser settings, as browsers with the “do not track” setting enabled still have the ability to accept cookies. Vigit does not recognize web browser “do not track” signals at this time. Instead, information collection and disclosure practices and the choices that Vigit provides to users will continue to operate as described in this Privacy Policy, whether or not a “do not track” signal is received. We may work with third parties that use tracking technologies, including in order to provide tailored advertisements on our behalf and on behalf of other advertisers across the Internet. These companies may collect information about your activity on our services and other websites over time, as well as your interaction with our advertising and other communications, and use this information to determine which ads you see on third party websites and applications. Other Websites and Links 

The Website and the App include links to other third-party websites, which are not operated by Vigit, that we think may be of interest to you, including, but not limited to links to Vigit’s accounts on various social media websites. These third-party websites have separate data collection and privacy practices independent from ours, and Vigit is not responsible for the policies or activities of such other websites. Please contact such third parties directly if you have questions about their privacy policies. 

Referral Programs 

We may allow you to refer friends to the Website and App via email and social networking platforms. If you refer a friend by email or text, we will collect the name and email addresses of proposed recipients or, if applicable, the name and mobile number of your friends to send the email or text on your behalf. We may also use your name and email address in order to identify you as the initiator of the email. Please inform your friends that we may send them emails or texts on your behalf. 

If you refer a friend via any social networking platform, you will be subject to the privacy policy and the terms and conditions of the specific social networking platform. Some social networking platforms enable functionality that allows a user to receive and transmit data to the social networking platform through use of overlays or other technology. Although it appears the data is collected by us, the data is in fact collected directly by the social networking platform. If you decide to use this functionality, the data to be transmitted will be collected directly by the social networking platform, and we do not receive, collect or use the information. Please note your social networking account settings, as those settings will affect how and with whom your posts, information and other content are shared. 

Retention and Disposal of Personally Identifiable Information 

To the extent permitted by applicable law and subject to this Privacy Policy, we retain personal information we obtain about you as long as (i) it is needed for the purposes for which we obtained it, in accordance with the provisions of this Privacy Policy or (ii) we have another lawful basis for retaining that data beyond the period for which it is necessary to serve the original purpose for collecting the data.
